Subject: UNFAIR COMPETITION BOARDS OF FAMILY SERVICES IN THE PROVISION OF MEDICAL EXAMINATION OF INCOME AND HEALTH FOR THE GRANTING OF SUBSIDIES

GREETINGS

To Remember purposes they deem appropriate and will forward a copy of the response of the Superintendency of Family Subsidy with respect to the provision of occupational health services at subsidized rates, which in our view becomes unfair competition for those who provide these services on market competition and is not considering that these grants of Family Compensation Act are targeted beneficiaries workers and not their employers, according to our knowledge of the system. In that vein, what these boxes would be doing is transferring a subsidy for workers to companies as it is of them as employers, the legal obligation to ensure the health of workers and make their entrance exams cost, periodic inspection and removal of the worker, as clearly stated in the Decree Law 1295 of 1994 and Resolution 2346 of July 11, 2007 and June 1918 5, 2009 the Ministry of Social Protection, norms regulating the General System of Occupational Hazards and practice of occupational medical evaluations.
The Professional Risk Managers (ARP), responsible by law for carrying out activities aimed at promoting, promotion and prevention of health risks at work, can not take in the activities to fulfill this obligation, the performance of these entrance examinations, since its performance is part of the obligations which the law gives employers, so the Ministry of Social Protection has exhaustively prohibited.

believe then that these same considerations apply to the case of Family Compensation Funds, and therefore, we see that is the law set to provide subsidies to occupational health services and is provided under this understanding that we refer to unfair competition as the basis of our complaint, it is clear that other institutions providing occupational health services do not have the possibility of offering subsidies to compete and stay in business.

For all the above, we believe that the reasons for our complaints have been validated by the responses and we hope the show achieves Supersalud such practices harmful to the professionals we provide this service and threatening the development of Occupational Medicine .
